1. Acceptance of terms

By accessing or using BioPulse, you accept these terms. If you disagree, do not use our services.

2. Beta version

The user accepts that BioPulse is in a beta development phase, which means:

• It may contain technical or functional errors.
• Features may change, be interrupted or removed without prior notice.
• Continuous availability and full stability are not guaranteed.
• Access to data and statistics is limited to the email address initially registered.

3. Minimum age

Use of BioPulse is limited to people aged 16 or over, in accordance with Article 8 of Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). By registering, the user declares and warrants that they are at least 16 years old. Users aged 16 or 17 additionally declare that they have read and understood the Privacy Policy and that they consent to the processing of their biometric data as described therein. We recommend that minors consult a parent, guardian, or healthcare professional before starting or modifying any training routine based on the metrics shown in the app. Accounts found to belong to users under 16 may be suspended or deleted without prior notice.

4. Service description

BioPulse provides a real-time biometric monitoring platform that includes: Coach App for trainers, Web Portal for center management, User App for members, and the PulseScore™ algorithm for effort normalization.

5. Registration and account

You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your credentials and all activity on your account. During the beta phase, access is only allowed via the email initially registered; login via social networks or other external systems is not supported, and access recovery is not guaranteed if the email is lost.

6. Acceptable use

You agree to use BioPulse lawfully and respectfully. It is prohibited to: attempt to access other users' data, reverse engineer the PulseScore algorithm, use the service for unauthorized purposes, or intentionally overload our systems.

7. Biometric data

BioPulse collects biometric data to provide the service. This data does not constitute medical advice. Always consult a healthcare professional before modifying your exercise routine based on our metrics. Users aged 16 or 17 are strongly encouraged to consult a parent, guardian, or healthcare professional before making training decisions based on BioPulse metrics.

8. Intellectual property

BioPulse, PulseScore™, and all associated content, design, and technology are owned by Symbionix S.L. A limited, non-exclusive, revocable license is granted to use the service under these terms.

9. Limitation of liability

BioPulse is provided "as is". We do not guarantee that the service will be uninterrupted or error-free. In no event shall we be liable for:

• Indirect, incidental or consequential damages arising from use of the service.
• Damages arising from misuse of the platform.
• Personal decisions made based on metrics shown in the app.
• Loss of data due to unauthorized access to the user's email.

10. Plans and billing

Subscription plans are billed according to the contracted period. Prices may change with 30 days' prior notice. Non-payment may result in service suspension.

11. Cancellation

You may cancel your account at any time. After cancellation, your data will be deleted according to our privacy policy.

12. Modifications

We may update these terms. We will notify you of significant changes. Continued use after notification implies acceptance of the new terms.

13. Governing law

These terms are governed by Spanish law. For any disputes, the courts of Barcelona shall have jurisdiction.

14. Service provider identification
